These Terms of Service (“Terms”) govern your access to and use of Erasly, including the mobile
application and the website operated under the domain refineailab.com (collectively, the
“Service”).
The Service is provided by RefineAiLab (“we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the
Service.
1. Eligibility and Acceptance
By using the Service, you confirm that:
You are legally capable of entering into a binding agreement under applicable law.
You will comply with these Terms and all applicable laws and regulations.
You own, control, or otherwise have the necessary rights to use, edit, and process any images you submit
through the Service.
2. Description of the Service
The Service is a specialized image-editing application that provides
AI-powered object removal and background reconstruction using server-side generative
inpainting technology.
The Service is intentionally designed as a focused object removal tool and is not a
general-purpose photo editor.
Core functionality includes:
Removal of unwanted objects, people, and minor imperfections
Generative background reconstruction
Secure server-side AI processing
Before/after comparison
Saving and sharing edited images
Multi-language interface
3. Access Model and Business Terms
3.1 Introductory Complimentary Access
New users may receive one (1) complimentary AI processing request to evaluate the Service.
This introductory access:
Is available once per Apple ID
Does not renew
Becomes unavailable after the first successful subscription purchase
The availability or quantity of complimentary requests may change in the future. Any changes apply
prospectively and do not affect previously granted access.
This introductory access is separate from any Apple-configured free trials that may appear in App Store
purchase dialogs.
3.2 Subscriptions
The Service offers weekly auto-renewable subscriptions via Apple In-App Purchase.
Available plans may include, depending on region:
Light — 20 AI processing requests per week
Medium — 60 AI processing requests per week
Professional — 120 AI processing requests per week
Each active subscription provides:
Access to all AI editing features
A weekly usage quota that resets upon successful renewal
Use across devices signed in with the same Apple ID
Prices vary by region and are displayed in the App Store prior to purchase.
3.3 Subscription Terms
Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the
end of the current billing period.
Payment: Charges are billed to your Apple ID at confirmation of purchase and upon renewal.
Cancellation: You may cancel at any time through your Apple ID subscription settings.
Cancellation takes effect at the end of the current billing period.
Quota reset: Weekly usage quotas reset only after a successful subscription renewal.
Unused quota: Unused AI processing requests do not roll over to subsequent periods.
Refunds: All refunds are handled exclusively by Apple in accordance with Apple’s refund policies.
3.4 Restore Purchases
Purchases may be restored on any device signed in with the same Apple ID.
Restoring purchases restores access to an active subscription.
Restoring purchases does not reset, increase, or accelerate usage quotas, which remain governed
by the current subscription period.
4. Usage Limits and Fair Use
Each successful AI processing request counts toward the applicable usage quota.
Requests that fail due to:
Content moderation rejection
Network errors
Technical failures
do not deduct quota.
We reserve the right to limit, suspend, or terminate access in cases of abuse, fraud, automated usage, or attempts
to circumvent usage limits or technical safeguards.
5. Acceptable Use
You may use the Service only for lawful purposes and only with content you have the legal right to use.
You agree not to use the Service to:
Process explicit, pornographic, or sexually exploitative content
Involve minors in unsafe, sexualized, or exploitative contexts
Create deceptive or misleading media, including unauthorized deepfakes
Violate privacy, publicity, or intellectual property rights
Circumvent subscriptions, quotas, or security mechanisms
Use automation, bots, scraping, reverse engineering, or bulk processing without authorization
Commercial Use
You may use images processed through the Service for personal or commercial purposes, provided that:
You own or have the necessary rights to the original images, and
Such use complies with applicable laws and regulations.
6. Content Moderation
Submitted images are screened by automated AI-based content moderation prior to processing.
Images rejected by moderation:
Are not processed
Are not retained
Do not count toward usage quota
A rejection does not imply wrongdoing by the user.
7. Intellectual Property
7.1 Your Content
You retain ownership of all images you submit.
You grant us a limited, non-exclusive, non-transferable license to:
Process images solely to provide the requested Service
Temporarily store images as necessary for processing and limited retries
Use aggregated, non-identifying operational data to maintain and improve service reliability
We do not use user images for AI training, advertising, or marketing without explicit consent.
7.2 Our Property
All software, design, branding, and content of the Service are the exclusive property of RefineAiLab or its
licensors.
You may not copy, modify, distribute, or create derivative works without prior written permission.
8. Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Availability and Technical Limitations
The Service requires a compatible device, supported operating system, and an active internet connection.
AI-generated results may vary depending on image content and complexity.
We do not guarantee uninterrupted, error-free, or always-available service.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available”, without warranties of any kind.
To the maximum extent permitted by law, we disclaim all express and implied warranties, including warranties of
merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
AI-generated results are probabilistic and may not always meet subjective expectations.
To the fullest extent permitted by applicable law:
RefineAiLab shall not be liable for indirect, incidental, special, or consequential damages.
Our total liability shall not exceed the greater of:
The amount you paid for the Service in the twelve (12) months preceding the claim, or
USD $100.
Nothing in these Terms limits liability where such limitation is prohibited by applicable consumer protection laws.
12. Indemnification
You agree to indemnify and hold RefineAiLab harmless from any claims, damages, or expenses arising from:
Your violation of these Terms
Your misuse of the Service
Content you submit through the Service
13. Termination
We may suspend or terminate access if you violate these Terms or misuse the Service.
You may stop using the Service at any time. Unused quotas are not refundable except where required by applicable law.
14. Changes to the Terms
We may update these Terms periodically.
Updated versions are published on our website and within the Service. Continued use of the Service after
publication constitutes acceptance of the revised Terms.
15. Governing Law and Consumer Rights
These Terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules.
If you are a consumer residing in the European Union or the United Kingdom, mandatory local
consumer protection laws apply. Nothing in these Terms limits or waives your statutory rights under applicable
consumer protection regulations.
16. App Store and Apple Terms
All purchases are processed exclusively through Apple In-App Purchase.
Apple is not responsible for the Service or its content.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
We do not:
Use alternative payment methods
Offer digital content outside Apple’s payment system
